New Consent Requirements for Telephone Calls and Text Messages Effective October 16th New FCC consent requirements for phone calls and text messages went into effect on October 16, 2013. Dealers should review the rules and work with their counsel and any third party vendors to ensure that all phone calls and text messages they make or send (or that are made or sent on their behalf ) meet these new requirements. Used Vehicle Prices Fall by Largest Amount in Two Years Wholesale used vehicle prices for units up to eight years in age fell by 3.5% in October, nearlyapoint higher than thedecline recorded in September. This marked the largest fall since October 2011’s similar drop of 3.5%. Analysts at the NADA Used Car Guide believe that if the government shutdown hadn’t oc- curred in September and October, the rate of decline would have most likely been directly in linewith recent seasonal norms. The NADA Used Car Guide produces a monthly report on new and used vehicle sales trends and price movement called Guidelines. In an effort to assist dealers with under- standing their rights under the law, NJ CAR has posted a copy of the entire New JerseyFranchisePracticesAct (brokendown by Section) as the lead story on the Member side of the NJ CAR website (http://www. njcar.org) . TheCoalitionalsohasaFranchise Practices Act Committee that is working on possible amendments to the law that will address various issues and add some “teeth” that will cause manufacturers to think twice beforeignoringNewJersey’slawinthefuture. It’s amazing how quickly the industry has changed in the six short years since I last served as NJ CAR Chairman. In 2007, we had nearly 650 dealerships in New Jersey and the recession was just beginning to take shape. Fast-forward to 2013 and we now have 515 dealerships and we are leading the State and country’s economic recovery with auto sales moving closer and closer to pre-recession levels. I don’t have a crystal ball and wouldn’t at- tempt to predict what will happen in 2014, but I am sure that we can accomplish great things when we listen to each other, work with each other and speak with one strong voice.
