The recal l involves the vehicle’s front airbags, which have a defect which can cause unwanted and unnecessary inflation and deployment of the airbags. Attached are copies of any notices or other information the dealership has received from the manufacturer regarding this safety recall. At this time there is a shortage of parts available to perform the needed repairs to correct the airbag defect. The manufacturer has stated that parts will start to become available in approximately four months, and that enough parts to repair all affected vehicles will not be available for months afterwards. Buyer Acknowledgement and Release/Waiver Buyer acknowledges that dealership has informed Buyer of this defect, and that Buyer has elected to purchase the vehicle in its present condition, subject to the open safety recall. Buyer assumes all risk of damage and/or personal injury which could result from the airbag defect which is the subject of the recall. Buyer agrees to waive and release any claim or action against dealership arising out of or relating to the sale of this vehicle subject to the recall or arising out of the occurrence of any event or incident involving the subject of this recall. Buyer acknowledges that Buyer is solely responsible for assessing the degree of risk and making the decision to purchase and use the vehicle in its present condition. Dealership makes no representations as to the safety of the vehicle or the degree of risk associated with its use. Buyer is solely responsible for having the required repairs performed under the recall when the manufacturer has made the needed parts available.
