O R G will periodically organize in-person meetings with affected members to update dealer principals and senior management as needed. Unfortunately, given the legal and regulatory complexity of today’s world, no amount of reference material can equip dealers to confront every issue. Accordingly, NJ CAR employs staff attorneys who are available daily by both telephone and e-mail to provide general business advice on an “as needed” basis. We are tasked with continuously monitoring the law for trends and changes. We routinely address members’ questions regarding motor vehicle titling and registration, dealer licens- ing, the Sales and Use Tax, wage and hour laws, financial regulations, consumer fraud laws, motor vehicle advertising regulations and much more. Although NJ CAR is not a law firm and cannot provide direct legal advice, the Coalition can communicate the best practices and identify legal traps and pitfalls before they metastasize into costly litigation or regula- tory enforcement action. And when litigation or enforcement action is inevitable or has already commenced, we can provide reliable referrals to lawyers who are trustworthy and under- stand the automotive retail industry. These daily interactions between NJ CAR’s staff attorneys and inquiring members serve two useful purposes. As mentioned above, they help our members adopt best practices and identify legal problems. However, they also help NJ CAR identify problematic trends so that we can address them early across our entire membership before they spin out of control. Again, simply ignoring legal and regulatory compliance in to- day’s hyper-legal world entails significant risk. Taking just a few minutes to make a telephone call or send an email to NJ CAR’s staff attorneys to determine a best practice or spot a potential issue can save you thousands or even millions of dollars in potential legal fees and/or damage awards.
