Dealer Data and Related Digital Issues are High Priority for NADA 2019 NADA Chairman Charlie Gilchrist recently published a column that dis- cussed the importance of protecting deal- er (and consumer) information. Below is a condensed version of Charlie’s column. The volume of information generated and stored has exploded, and that information is more sensitive and more valuable than ever. It’s no longer just the dealer generat- ing this information; “big data” companies and data brokers hold vast amounts of data. At the same time, the number of third parties with whom a dealer must share information has also increased. The collection, storage, use and sharing of this information raises many complicated legal, regulatory and business issues for dealers, including: • How can data be shared securely? • What information should be shared and how does a dealer ensure it’s not being misused? • Who has the right to control the inte- gration, the dealer or the vendor? • Are dealer systems secure, and are they ready for integration with the vehicle? • What information can an OEM require a dealer to share? • What “telematics” and other infor- mation is your manufacturer sharing with you? • How can dealers and OEMs share information while meeting their legal requirements? At the same time, dealers must meet long-standing federal privacy obligations while understanding the implications of any new State or federal laws that could potentially impact the auto retail industry. Dealers must meet these technical and legal challenges head-on. Dealers should know that this issue is a top priority at NADA. For many years, NADA has worked closely with regulators, manufacturers, dealer vendors and others to ensure that dealers have the tools they need to comply with all applicable laws and are ready for the technical, cybersecurity, and data challenges in the future. Dealers play a pivotal role as well. Prior- itize data security at your store. Double down on compliance efforts. Talk to your manufacturer about these issues and let them know how important they are to you and your business. Work with your vendors to ensure you know and under- stand how your customer information is handled and shared. Remind your em- ployees how important it is that this infor- mation is treated with the utmost care. The data dealerships maintain is at the heart of the customer relationship. Dealers are facing challenges, but NADA stands ready to provide dealers with cutting-edge technology and privacy protections.
